KNOW YOUR STATUS
ACTIVE
ACTIVE means your Nonprofit Corporation is up to date and filed the required annual paperwork, and filed the IRS 990 form and meet all the requirement to do business in the state, and is recognized with the rights and privileges of a 501c3 designated organization which means you can solicit tax-deductible donations, and pay no business taxes. Of course there are additional perks and benefits but those relate directly to legal compliance.
DEFAULT
DEFAULT means the organization has missed filing the state’s annual legal compliance paperwork, usually call the Annual List of Officers, or Annual Information Report, and is late. Mosts states let the organization stay in this status for 12 months but upon missing the 2nd year of filing the status transitions to Revoked. IRS does not put organizations in the ‘default’ stage.
REVOKED
REVOKED means the organization is noncompliant and not conducting operations legally. You have no legal status or rights. As mentioned, IRS does not have a ‘default’ stage. Annually the 990 form must be filed and if the organization misses 3 years of filng, the organization automatically is revoked.
On both the state and IRS level, when an organization is revoked the entire application process must be done again as if you are a new entity. It is called a reinstatement and subject to full fees.
On the state level the fees also include past filing with late fees. For example in Nevada, an organization is revoked because they did not file the Annual List of Officers for years 2020 and 2021. To become compliant again they must file for a certificate of reinstatement ($100), plus they will be assessed the 2020 filing fee and late fee ($100), 2021 filing fee and late fee ($100), and 2022 filing fee ($50). Total: $350
For IRS the organization must apply again using the full 1023 application and pay the full application fee of $600. This applies even if you may have done the 1023ez originally.
